Learning outcomes

After successful completion of the course, students are able to understand the basic requirements resulting from the procurement law ("Bundesvergabegesetz"). This information can be used in the planning phases of IT projects. Based on that, students will be able to recogize the specifically needed documents for a public bidding process.

Restrictions resulting from procument law and contractual law which limit the planning of IT systems and the project management phases for their implementation will be known and can be considered.

Students will also be able to plan the basic phases of a public bidding process and consider the relevant parameters for it. Circumstances which are in contradiction with the procurement law can be identified, and legal measures considered.

Subject of course

Classification and Structure of IT Projects. Methods for evaluating and specifying relevant norms and standards. Procedures for System Development: requirements, modeling, and optimization. Examples of multi-vendor integration Projects. Basic concepts of contract law: Contracts, Defects, Guarantees. Public procurement in accordance with Austrian Standard A2050. Licencing and accrediation of qualified bidders. Basic concepts of the European Public Procurement Directive. Austrian Federal Procurement Law, jurisdiction, and application. Technical specification, functional requirements vs descriptive specification. Contract award procedures, Participation in contract award procedure, selection of candidates, deadlines, award criteria, awarding of contract. Actual examples and decisions.

Teaching methods

Presentation of the necessary splitting in project phases and of the technical and legal requirements for planning IT public procurement processes.

Presentation and discussion of typical examples for the planning of the different types of IT systems including real samples of public and recent projects.

Discussion of sample documents for a comple bidding process including technical specifications and legal documents. Discussion of legal decisions and legal measures available under public procurement law.

Examination modalities

Approximately 10 questions to the details of procurement and contractual law. Students need to know the types of public bidding processes and their application, the essential parameters for the planning and specification of IT systems and of a public procurement process, examples have to be provided.

In addition: 1 sample case of an IT contract with questions regarding warranty and compensation for damages and its coverage in the bidding process.
