After successful completion of the course, students are able to interpret and apply detailed development plans and land use plans. In detail, they have following relevant competences:
- content of such plans, symbology, possibilities for regulation
- admissability/obligation to create/amend detailed development plans and land use plans
- constitutional framework conditions of such plans
Building on the teaching content of previous courses (in particular Land Law and Spatial Planning Law), the basics of spatial planning law, procedures and legal effects of zoning and development plans as well as building regulations are covered within this lecture. Based on essential jurisdiction of the supreme courts regarding zoning and development plans, the municipal planning discretion concerning specific regulations, the legal possibilities of citizens (especially the rights regarding the landowners), as well as planning conflicts and solutions are discussed. The interactions with other planning instruments will be elaborated, in particular regarding planning contracts and land reallocation.
Furthermore, regulations of building codes (e.g. Lower Austria) such as the provisions of the arrangement of structures on properties, the determination of building heights, the regulation of traffic development, various usability regulations, etc. are presented and discussed. In addition, differences in the specifications regarding building regulations of the federal states based on actual projects (usability figures, plan symbol ordinances, etc.) are presented within this lecture. Finally, exemplary legally binding development plans are shown and the scope for interpretation regarding the structural and spatial formulation is discussed. Students are supported in drafting a development plan based on the design concepts developed in Project 1.
The course is planned as a presence course this summer term!
The course uses a set of methods to measure up to the defined course format:
- 4 plenary sessions with lectures and discussions
- individual preparation and solving task for the plenary online sessions
- individual preparation on supreme court decisions and active participation in online sessions
- individual creation of a detailled planning profile of a plot
- drafting a detailed development plan
