After successful completion of the course, students are able to legally assess simple issues of the Austrian constitutional and administrative law. They can solve them independently by applying the relevant legislation and jurisdiction as well as legal interpretation methods.
Following the relevant lecture on Constitutional and Administrative Law this cource deals with legal issues in the field of: definition and function of law; state and constution; the basic principles of the Austrian Constitution; state powers and state organisation; elections and law-making; fundamental rights; organisation, tasks and type of actions of the administration; basics of EU law: evolution, authorities, competences, legal acts, internal market; specific administrative law: planning and building law, plant permit law; procedural law and judicial review
Online-exercises in the form of case studies, the students have to prepare. Within the lecture the legal solution of the case is elaborated together, by using legal online research tools and by applying the relevant legal acts. Interesting judgements of the higher courts are discussed together.
Written exam (legal solution of a case study). Structure of the argumentation is valued specifically. Performance of the participants within the lecture.
