After successful completion of the course, students are able to answer fundamental legal questions in the area of contract and liability law. They know how contracts are concluded, how to classify legal problems in contract performance and what the consequences of such disruptions are. The students can distinguish between classic contract types and know the specifics of IT contracts. The aim of the lecture is to make it easier for students to communicate with lawyers in their professional life and to enable them to independently identify legal problems in the area of contract and liability law in their practical work.
Introduction to private law; Introduction to contract law; Conclusion of contracts; Property law (especially acquisition of property); Defects in the contract; Performance disruptions; Liability law; classic contract types, IT contracts.
Lecture part: preparation of the material using PP foils and text; Exercise part: repetition and deepening of the material using case studies, open-ended and multiple-choice questions.
Written exam and participation in the practice part.
Important:
1. The submission the exercise part is a mandatory requirement for the written exam!
2. Only students, who were validly registered for this VO in SS 2022 in TISS, are admitted for the exam!
3. Attendance is compulsory for registered students. The absence of the first unit leads to an automatic deregristration. One-time excused absence is permitted. An unexcused or second absence leads to a negative grade.
The exams will take place in person until further notice. You will receive detailed information on the examination modalities via TUWEL before the examination. You have to register for the examination separately!
Da die Teilnehmeranzahl für die VU Haftungs- und Vertragsrecht auf 40 Personen beschränkt ist, gelten folgende Anmelderegeln:
- Studierende der Studienrichtung 033 526 u. 033 533 (Gebundes Wahlfach im 6 Sem) werden prioritär zugelassen
- Sollten dann noch Plätze übrig sein, werden Studierende der Studienrichtungen 033 534 nach Anmeldedatum zugelassen.
- Sollten dann noch Plätze frei sein, werden alle anderen Studienrichtungen nach Anmeldedatum zugelassen.
Für die angemeldeten Studierenden gilt durchgehend Anwesenheitspflicht. Das Fehlen bei der ersten Einheit führt zu einer automatischen Abmeldung von der LV. Ansonsten ist ein einmaliges Fehlen zulässig. Zwei Mal Fehlen nach der ersten Einheit führt zu einer negativen Beurteilung der LV.
